Tenders must be open for acceptance until WEDNESDAY, JUNE 18, 2025.
The seller or Niblock & Company LLP will notify the successful bidder on or before 4:00 p.m. on WEDNESDAY, JUNE 18, 2025 by telephone (or email or fax where such information is provided) when the tender has been accepted. The closing of the sale and the balance of the purchase price shall be paid on or before 12:00 PM noon on the 30th day of OCTOBER, 2025 (the “Closing Date”). The seller shall be responsible for all costs in preparation of registerable transfers for the land and the successful bidder shall be responsible for all costs of registration of the transfer of land. Any applicable GST will be added to the tender price.
These terms of tender shall not be inconsistent with this tender notice or matters expressly stated to be terms in the tender package or the additional terms, and the same shall form the contract between the bidder and the seller.
The seller reserves the right to reject any or all tenders, and to waive formalities or other provisions in a sale as the seller may wish having regard to the seller interests without stating reasons or giving notice. The highest or any tender may not necessarily be accepted. The seller reserves the right to negotiate on any tender or otherwise to negotiate outside of tenders on the sale of any lands.
The seller will accept offers conditional on financing so long as the date for satisfaction or waiver of the financing condition is on or before July 10, 2025.
The seller shall not be liable for any costs, expenses, loss, or damage incurred, sustained, or suffered by any bidder/tenderer prior, or subsequent to, or by reason or the acceptance or the non-acceptance by the seller of any tender or any related matter.
